The Prosecutor General’s Office (PGO) has decided not to prosecute President Dr. Mohamed Muizzu over the alleged threats made against the CEO and journalist of Adhadhu Hussain Fiyaz via phone call, citing that there is no legal framework to proceed against the complaint filed against the president.

In a notice posted on X Monday evening, PGO said they had received a case filed by Fiyaz regarding a phone call that took place on March 14, around 7:04 p.m. that day. They said the police submitted this case to them on March 23, and after reviewing the information and the current legal framework, they have decided not to go forward with the case.

The complaint alleges that President Muizzu had threatened to take the “strictest action possible” against Fiyaz to the full extent of the law. However, according to the PGO, this statement does not fit within the threshold of threats as defined under Section 120 of the Maldives Penal Code, which determines it an offense to threaten to cause bodily injury against another.

The statement also said the complaint does not fall within the threshold of Section 2 of the Prevention of Dangerous Weapons Act.

Section 2. (a) of the Prevention of Dangerous Weapons Act defines “threatening” as “It is an offence to threaten or threaten to harm a person’s life or body, a family member or a person under one’s care,” while Article (b) considers it an offence to threaten or threaten to cause harm to a person’s property, place, object, or a marine vessel or a land vehicle that belongs to them.

Referring to the aforementioned articles in the two laws, PGO decided there are no legal grounds to take legal action against the President.

“No further action will be taken against this case,” PGO said in their statement.
